File Montana v. Wyoming
This excerpt from the suit brought by Montana against Wyoming in the US Supreme Court alleges an increased consumption of water by those irrigators upstream in Wyoming who employ more efficient irrigation techniques. As a note, the Special Master recommended and USSC agreed that the increased use resulting from increased irrigation efficiency did not violate the Compact between the states. See "Montana v. This headnote from the USSC attempts to explain their ruling against Montana with respect to increased irrigation efficiency and its impact on the downstream Montana users. While apparently acknowledging the increased depletions by Wyoming and the effect that may have on the Montana water users, the Court found that because neither the Compact nor state law addressed increased depletions resulting from increased irrigation efficiencies, there was no basis for a claim.
